When the Family Has to Fight for the Legacy

October 13, 2026Legacy Planning, Black Family Wealth, Black Wealth, Legacy, Generational Wealth, Family, Living Trust, Famous Estates

Estimated read time: ~5 minutes

A family can love the same person and still end up on opposite sides of a courtroom.

That is one of the hardest truths in estate planning.

The public often sees the celebrity name first. Malcolm-Jamal Warner. Chadwick Boseman. A beloved actor. A cultural figure. A life that meant something far beyond the screen.

But behind the headlines are questions that many families recognize immediately.

Who had authority?

Who was supposed to receive what?

Was the estate plan current?

Were the right people named?

Were promises made that never became documents?

Did the family understand the plan before grief took over?

TheGrio recently connected estate disputes involving Malcolm-Jamal Warner and Chadwick Boseman to a much larger issue affecting Black families nationwide: too many families are still forced to sort out wealth, property, caregiving, marriage, children, parents, promises, and legacy after someone has already passed away.

By then, the person who could have explained everything is gone.

And silence becomes evidence everyone interprets differently.

For Black families, this is not just a legal issue. It is a wealth-protection issue. It is a family-stability issue. It is a legacy issue.

Because the estate is rarely just money.

It may be a home. A trust. A life insurance policy. Retirement accounts. Intellectual property. A family business. A caregiver arrangement. A promise to a spouse. A responsibility to a child. A duty to aging parents. A lifetime of work that everyone believes they understand — until the documents say otherwise, or say too little.

A plan that is missing, outdated, or unclear can turn grief into suspicion.

And suspicion can turn family into opponents.

The lesson is not that every family will fight.

The lesson is that every family needs clarity before there is something to fight about.

A will may express wishes, but it may not avoid probate. A trust may exist, but it may not reflect a marriage, a child, a death, a divorce, a new home, a business, or a changed family reality. A beneficiary form may quietly override what the family thought the plan said. A life insurance policy may not match the promises people remember. A spouse, parent, child, or caregiver may believe they are protected, only to discover that the legal documents did not say enough.

That is how private pain becomes public conflict.

Not because the family failed to love one another.

Because the plan did not protect them from uncertainty.

For many Black families, the stakes are especially high. Wealth has often been built slowly, against pressure, through homeownership, work, sacrifice, caregiving, and family support. One unclear estate plan can expose that wealth to court delays, legal fees, taxes, creditors, family division, and preventable loss.

A strong estate plan should answer the questions your family should not have to guess at later.

Who has authority if you become incapacitated?

Who can speak with doctors?

Who can pay bills?

Who manages the trust?

Who receives the home?

Who protects minor children?

Who receives life insurance?

Who manages retirement accounts?

Who carries out promises made to a spouse, children, parents, or other loved ones?

Who is the backup if the first person named cannot serve?

These questions may feel uncomfortable while everyone is alive.

They become far more painful when the family is already grieving.

Protect the Plan Before Grief Takes Over

If your home, trust, deed, beneficiary forms, retirement accounts, life insurance, powers of attorney, healthcare wishes, caregiving roles, or family instructions have not been reviewed, now is the time to begin.

Join Collins Law Group for the October 21st In-Person Wills, Living Trusts & Asset Protection Seminar, starting at 10:00 AM.

This seminar will help families understand how proper planning can help reduce confusion, protect the family home, prepare decision-makers, and preserve the wealth your family worked too hard to build.

The hardest part of estate planning is often admitting that love is not enough.

Love does not update a trust.

Love does not change a beneficiary form.

Love does not give someone legal authority at the bank.

Love does not tell the court what you meant.

Love does not automatically protect a spouse, a child, a parent, a caregiver, or a family home.

Documents do that.

Clear instructions do that.

A coordinated plan does that.

At Collins Law Group, we believe family wealth protection requires more than having “something in place.” It requires making sure the plan still reflects your real life.

That includes the house. The trust. The will. The deed. The beneficiary forms. The life insurance. The retirement accounts. The powers of attorney. The healthcare directives. The successor trustees. The caregiving roles. The promises made to the people you love.

If those pieces do not work together, the family may be left to solve the problem after you are gone.

And by then, even a loving family can fracture under the weight of unanswered questions.

The goal is not simply to avoid court.

The goal is to protect the people from becoming divided over the very legacy meant to care for them.

Final October 21st Seminar Nudge

Testimonials

Client Review
August 19, 2020

“My mother told me about the Collins Law Group and I must say, the entire experience has been a real pleasure. Although I was nervous at first, the Collins Law Group staff put me at ease with their friendliness and knowledge. I didn’t realize how hard it could be on your family and loved ones left behind if you die without any planning or directions in place for them. My biggest concern was making sure my elderly mother would be provided for and taken care of if something happened to me. I have been a caregiver for her for 12 years, so this planning was crucially important. I had previously made a living trust for myself on Legal Zoom but there is no comparison to the level of service and professionalism that Collins Law Group embodies. Attorney Collins and her staff provides excellent service and it will take a large burden off of my family when they need guidance at the time of my passing.”
