The Plan Your Family Needs Before the Hospital Calls

October 8, 2026Cognitive Decline, Family Trust Dispute, Living Trust, Alzheimers LA, Alzheimers, Dementia Awareness, Alzheimers Awareness, Family, Generational Wealth, Caregiver, trust administration, Estate Planning

Theme: Caregiving and Cognitive Decline
Estimated read time: ~5 minutes

Many families do not think about estate planning until after a diagnosis, a fall, a hospitalization, or a frightening phone call.

By then, everything feels urgent.

A parent is in the hospital. A doctor needs a decision. A bill is due. A sibling is flying in. Someone has to find the insurance card. Someone has to locate the trust. Someone has to figure out who can speak, who can sign, and who is legally allowed to act.

The family may love one another deeply.

But love does not answer the hospital’s paperwork.

Love does not unlock the bank account.

Love does not automatically give one child authority over the house.

Love does not tell doctors who should decide.

That is why the best time to plan is before the emergency.

Not because families should live in fear.

Because emergencies are hard enough without legal confusion.

The hospital call often reveals what the family never organized.

Is there a healthcare directive? Who is named? Is there a financial power of attorney? Where is it? Is the living trust current? Who is the successor trustee? Is the home properly titled? Are beneficiary forms updated? Does the caregiver have legal authority? Does the family know what the parent wanted?

These questions are difficult in ordinary times.

They can feel unbearable during a medical crisis.

For families facing cognitive decline, the urgency becomes even greater. A loved one may still be able to express wishes today, but that ability may change. Waiting can narrow the window for planning. It can also increase the chance that family members disagree about what the parent would have wanted.

Do Not Let the First Real Conversation Happen in a Waiting Room

A strong estate plan gives families more than documents.

It gives them direction.

It names the people who can act. It gives caregivers authority. It protects healthcare decisions. It coordinates the trust, home, beneficiary forms, and financial accounts. It reduces the number of decisions children must make while frightened or grieving.

If your home, trust, deed, beneficiary forms, retirement accounts, life insurance, powers of attorney, healthcare wishes, caregiving roles, or family instructions have not been reviewed, now is the time to begin.

For many Black families, this planning is also about protecting the assets that hold the family together. The home. The retirement account. The life insurance policy. The savings. The documents that determine whether the next generation receives stability or confusion.

At Collins Law Group, we believe healthcare planning, caregiving planning, and wealth protection are connected.

A plan should protect the person.

It should protect the caregiver.

It should protect the home.

It should protect the family from unnecessary court involvement, conflict, and delay.

Final October 20 Seminar Nudge

Do not wait until your family is already dealing with confusion, caregiving pressure, court involvement, outdated documents, or conflict over the home.

Testimonials

Client Review
August 19, 2020

“My mother told me about the Collins Law Group and I must say, the entire experience has been a real pleasure. Although I was nervous at first, the Collins Law Group staff put me at ease with their friendliness and knowledge. I didn’t realize how hard it could be on your family and loved ones left behind if you die without any planning or directions in place for them. My biggest concern was making sure my elderly mother would be provided for and taken care of if something happened to me. I have been a caregiver for her for 12 years, so this planning was crucially important. I had previously made a living trust for myself on Legal Zoom but there is no comparison to the level of service and professionalism that Collins Law Group embodies. Attorney Collins and her staff provides excellent service and it will take a large burden off of my family when they need guidance at the time of my passing.”
