Probate in California: What It Is, Why It’s a Problem—and How to Stay Out of It
Live in L.A.? Read this before you leave your family a mess.

Let’s get one thing straight: if you don’t have a real plan, California has one for you. And it’s called probate.
It’s long. It’s expensive. It’s public.

And it’s exactly what you want to avoid if you care about your legacy, your loved ones, or your hard-earned assets.

So if you’ve been putting off your estate planning, thinking “I’ll deal with it later,” later is now.
Because probate isn’t some vague legal concept—it’s a courtroom process that can lock your family in limbo for 9 to 24 months, even when everything seems straightforward.

Want the playbook on how to avoid it?
Join us for a free in-person seminar at Collins Law Group:

So, What Is Probate?

Probate is the court-supervised process that kicks in when someone dies. It handles:

  • Validating your will (if you have one)

  • Appointing someone to manage your estate

  • Paying off debts

  • Distributing what’s left to your heirs

Sounds simple, right? But in California, it’s anything but.

California’s Probate Code = Red Tape on Steroids

Unless your estate is worth less than $184,500 (and most people’s aren’t), your assets go through the full court process. That means your family:

  • Waits months—sometimes years—for access to funds

  • Pays thousands in court fees, legal fees, and admin costs

  • Has your private finances published for anyone to see

If there’s no will, the court decides who gets what. If there is a will but no trust? Same mess, just with different paperwork.

Want to skip the mess and take control?
Get to our in-person event on May 14.

We’ll walk you through how to set up a Living Trust and keep your family far from probate court.

Why People Are Desperate to Avoid Probate (And You Should Be Too)

Let’s talk real-world pain:

  • Public exposure: Everything filed in probate becomes public. Your will. Your assets. Your debts. Your drama.

  • Delayed access: Your spouse, your kids, your people—they can’t touch what you leave them until the court gives the green light.

  • Sky-high costs: Probate fees in California are based on gross estate value (not net). Own a $1.5M house with a mortgage? The state still calculates fees on $1.5M.

It’s like giving away a chunk of your estate…to the system.

Enter the Trust: Your Probate-Proof Solution

If probate is the trap, a living trust is the escape hatch.
Here’s how it works:

✅ You move your assets (home, bank accounts, life insurance) into a trust.
✅ You name a successor trustee—someone you trust.
✅ When you pass, your trustee distributes everything privately, quickly, and without court interference.

No court. No delays. No drama. Just peace of mind and legacy protected.

✅ Stop leaving things to chance. Start leaving them to your family.

Your legacy isn’t built on what you leave.
It’s built on how well you leave it.
And in California, if you don’t plan ahead, the courts will plan for you.

Let’s make sure your last act is your strongest.

Client Review
August 19, 2020

“My mother told me about the Collins Law Group and I must say, the entire experience has been a real pleasure. Although I was nervous at first, the Collins Law Group staff put me at ease with their friendliness and knowledge. I didn’t realize how hard it could be on your family and loved ones left behind if you die without any planning or directions in place for them. My biggest concern was making sure my elderly mother would be provided for and taken care of if something happened to me. I have been a caregiver for her for 12 years, so this planning was crucially important. I had previously made a living trust for myself on Legal Zoom but there is no comparison to the level of service and professionalism that Collins Law Group embodies. Attorney Collins and her staff provides excellent service and it will take a large burden off of my family when they need guidance at the time of my passing.”
