Digital Estate Planning

    • What Is Digital Estate Planning—and Why You Need It

    • Digital estate planning is about securing your online accounts, digital assets, and intellectual property for your loved ones after you’re gone—or if you’re no longer able to manage them.

Think of it this way: your will might say who gets the house, but what about your Gmail account? Your crypto wallet? The content library you’ve been building for years? The Dropbox folder where your family photos live?

Without a plan, they may disappear. Or worse—get locked away permanently due to strict privacy policies and data regulations.

    • What Counts as a Digital Asset?

    • Let’s be clear—digital assets are more than just Bitcoin and email:

      • Social media accounts (Facebook, Instagram, X)
      • Online banking and investment platforms
      • Cryptocurrency wallets (Bitcoin, Ethereum, etc.)
      • Email inboxes and cloud storage (Google Drive, iCloud, Dropbox)
      • Digital media libraries (photos, videos, music)
      • Blogs, websites, and domain names
      • eCommerce stores or affiliate platforms
      • Loyalty rewards and airline points

If it lives online, it’s part of your digital estate.

    • The Danger of Doing Nothing

    • Without a digital plan in place, your loved ones could face:

      • Locked accounts: Companies like Apple, Google, and Facebook have rigid privacy policies that may deny access—even to immediate family.
      • Lost assets: Crypto, digital earnings, or online royalties could be lost forever without the right access credentials.
      • Legal limbo: Even with a traditional estate plan, digital assets may not be covered unless they’re explicitly included.
      • Family friction: Conflicts can emerge when no one knows your wishes—or who’s in charge.

    • How to Protect Your Digital Life

    • Creating a digital estate plan doesn’t have to be complicated, but it does need to be intentional. Start here:

      1. Inventory Your Digital Assets

Make a comprehensive list of your online accounts, platforms, and digital properties. Include URLs, usernames, and where credentials are stored.

      1. Choose a Digital Executor

Appoint a trusted individual who understands tech and can manage your digital estate. They’ll be responsible for accessing accounts, transferring assets, and honoring your wishes.

      1. Leave Instructions

Be specific: Should your social media be deleted or memorialized? Who should access your crypto wallet? What happens to your blog or YouTube channel?

      1. Secure Access

Use a password manager or encrypted file to store login details. Make sure your executor knows how to access it when the time comes.

      1. Update Legal Documents

Include digital asset provisions in your will or trust. California’s RUFADAA law allows your executor legal access, but only if you’ve authorized it in your estate planning documents.

    • Don’t Forget the Crypto

    • Cryptocurrency is the digital asset most at risk of being lost. Without access to your private keys or wallet credentials, there is no recovery process.

      To secure your crypto:

      • Record your wallet keys and passwords in a secure location
      • Identify who should inherit or manage your crypto
      • Include these assets in your estate plan

    • For Business Owners, Influencers, and Creators

    • If you earn income online, your digital presence is part of your business empire. Don’t let it vanish without a plan.

      You’ll need to:

      • Transfer domain ownership and admin access
      • Designate someone to manage or wind down operations
      • Include intellectual property in your estate documents
      • Protect customer data and business logins

    • Privacy After Death

    • Worried about what happens to your private data after you’re gone?

Here’s how to protect your digital privacy:

      • Include detailed instructions for deleting or managing accounts
      • Use a secure digital vault or encrypted storage
      • Regularly update your plan as accounts and platforms evolve
      • Ensure only trusted people have access to sensitive materials

    • Take the First Step Today

    • Digital estate planning isn’t something you can afford to put off. Your digital life is valuable—financially, emotionally, and practically. And the people you care about most are the ones who suffer if it’s not handled properly.

      By planning ahead, you:

      • Prevent legal headaches
      • Protect your family’s access
      • Safeguard your digital assets and income
      • Ensure your online legacy reflects your values

Whether it’s your crypto wallet, your Instagram memories, or your online business—if it matters to you now, it deserves to be protected later.

Start today. Your digital legacy won’t wait.

Testimonials

Client Review
August 19, 2020

“My mother told me about the Collins Law Group and I must say, the entire experience has been a real pleasure. Although I was nervous at first, the Collins Law Group staff put me at ease with their friendliness and knowledge. I didn’t realize how hard it could be on your family and loved ones left behind if you die without any planning or directions in place for them. My biggest concern was making sure my elderly mother would be provided for and taken care of if something happened to me. I have been a caregiver for her for 12 years, so this planning was crucially important. I had previously made a living trust for myself on Legal Zoom but there is no comparison to the level of service and professionalism that Collins Law Group embodies. Attorney Collins and her staff provides excellent service and it will take a large burden off of my family when they need guidance at the time of my passing.”
