Your Health Isn’t Protected Without a Plan: Why Estate Planning Is the Most Overlooked—and Urgent—Issue During National Minority Health Month

It’s National Minority Health Month, and across the country, the conversation is growing louder: health equity, access to care, culturally competent treatment. All absolutely essential. But here’s the twist nobody’s putting on a billboard—if we’re not talking about wealth protection and legacy planning, we’re missing the full picture of what health means in Black and Latino communities.

Because when we zoom in on what happens after the hospital visit, after the diagnosis, and after the funeral—we find a crisis just as urgent: millions of dollars in minority-owned assets being lost to the system. And not by accident.

The Quiet Wealth Drain Happening in Our Communities

Let’s get specific.

According to the most recent data from the Federal Reserve:

  • White families have a median net worth of $285,000.

  • Black families: $44,900.

  • Hispanic families: $61,600.

Now ask yourself: how much of that is protected? How much is documented? How many of those families have an actual plan for how that wealth moves to the next generation?

If you’re thinking, “I’ve told my kids what I want,” that’s where this conversation gets real.

Verbal Wishes Aren’t a Legacy Plan—They’re a Lawsuit Waiting to Happen

It’s human. You want to keep it simple. You tell your oldest, “Hey, the house is yours. Just split it with your siblings.” You believe your kids will honor your wishes. You trust your cousin to handle things fairly.

But California law doesn’t run on trust—it runs on documentation. And unless your wishes are legally written down, those verbal promises don’t mean a thing in court.

Let’s break it down:

  • Verbal instructions = no legal weight.

  • Family conflict = highly likely.

  • Assets left to one person “informally” = they legally keep everything.

Even if they want to follow your instructions, there’s no legal obligation. And if someone contests it? Get ready for court dates, legal fees, and a whole lot of emotional damage.

We’ve seen it time and again—especially in close-knit families where communication happens at the kitchen table, not in a lawyer’s office.

When the plan isn’t documented:

  • One sibling feels betrayed.

  • One cousin thinks they were left out.

  • One child is accused of “taking too much.”

Suddenly, the conversation turns from “What would Mom want?” to “I’m hiring a lawyer.” And that’s how generational wealth—built through sacrifice, sweat, and savings—gets burned in probate court.

It doesn’t have to be that way.

The Real Solution: Plan Like You Mean It

Legacy isn’t just about what you own. It’s about how you leave it.

Here’s how to do it right:

  • Create a Living Trust: This lets you control your assets while you’re alive and decide how they’re distributed when you’re gone—without going through probate.

  • Write a Valid Will: A clear will ensures your wishes are legally binding and enforceable.

  • Appoint an Executor or Trustee: Give someone the legal authority to carry out your plan—no guessing, no gray area.

  • Avoid “Just Put It in Their Name”: Titling a home or bank account in one child’s name and hoping they share it is not a strategy. It’s a gamble—and often a losing one.
